Haven Holiday Camp Compensation Claim

Haven Holiday camp compensation claim

In the UK any retailer or service provider owes their customers a duty of care. This extends through holiday providers and holiday park operators. They have a duty of care to maintain their facilities and train their staff in accordance with the law and industry guidelines, thereby ensuring the safety of both guests and staff at their parks.

If your holiday was booked as a package holiday, comprising two or more elements such as accommodation, transport, or other services which accounted for greater than 25% of the holiday, you are also protected under specific laws governing the operation of package holidays.

You can find out more about claiming compensation on a package holiday in this guide.

How much time do you have to make a personal injury claim?

When making any personal injury claim, you need to be aware that there are always personal injury claim time limits. As Haven holiday parks and camps are spread across the UK, you will either be making your claim under the system of England & Wales, or Scotland. In general, for most cases of a caravan site accident, such as burn injuries, or those from water sports, you have a three year window in which to make a claim. The point at which this three year window begins is as follows;

  • Three years from the date upon which the accident happened, if you were immediately aware of your injury or sickness.
  • In some cases, the effects of an accident may not become apparent straight away. If you find out that you are injured much later, this later date will serve as the date from which the time limit is counted.
  • In the cases of accidents to children, parents or guardians are able to make a claim at any point up till the child turns 18. After this, the victim has a standard three year period in which to start and make their claim.

Claims can take time to make and whilst three years may sound a long time, it is possible for very complex cases to take between eighteen months and three years to complete.

I was injured at Haven Holidays, can I make a personal injury claim?

The simplest answer to this question is yes. If you were injured as a result of negligence on the part of a holiday provider in the UK, whether in a hotel accident or a caravan site accident, you have the right to be compensated for the effects of this on you. If you booked and took your holiday in the UK, such as staying at a Haven Holidays park, you can claim compensation no matter whether you booked your holiday as a package deal, or simply booked your accommodation and subsequently purchased activities whilst at the holiday park. To find out more about your eligibility to make a personal injury claim, get in contact with our team here.

Activity accidents and injuries at Haven Holiday parks

Haven Holiday parks have a variety of different outdoor and water sport activities which guests of all ages can participate in. These can be purchased either at the time of booking your holiday as an ‘activity bundle’ or on site during your stay. Many of these activities, such as aerial adventures or paddleboarding have the potential to be dangerous if they are not properly supervised and if participants have not had the correct instruction.

As the service provider of these activities, Haven Holidays owe all participants a duty of care. They must ensure staff have the correct training to provide instruction, and that they are safely carrying out the activities in accordance with any guidelines recommended or industry. There should also be facilities or equipment on site to deal with emergency situations. If your accident was caused by the negligence of the instructor, or Haven Holidays, they may have breached their duty of care to you, thus enabling you to make a personal injury claim.

What to do if injured or sick at a Haven Holiday camp park

If you have been involved in any type of accident (or have been made sick) which is the faut of someone else, there are several things which you should do in order to enhance your chances of making a successful personal injury claim. Our first recommendation is always that you visit a medical practitioner and get any help you need. This should always be your number one priority. Below we have then included further steps that you can and should take if possible. We understand that in the immediate aftermath of an accident or injury, you may not be able to complete all of these. However, you can ask people to help you and always collect the necessary evidence at a later date.

Today most phones come equipped with high quality cameras, make sure your photo also includes a time and date stamp when you take the photo. You can use this to take a photo of the cause of your accident, such as damaged floor which you tripped over. This means we have a record of what caused it, in case this is subsequently repaired before you can make a claim.

Report the accident to Haven Holidays, both by reporting it to the site manager, as well through their customer services centre. Make sure that the on-site manager records the accident in their accident report log. This will create an official record within the company of what happened to you and what the cause was. This can be vital piece of evidence when making a claim.

When you do visit a doctor, hospital, or healthcare centre, ask for a copy of any medical records that they make. This gives us a record of what your injuries were, how serious they were, and what treatment needed to be provided. This report may also say how long it is likely to take you to recover. You may need to pay a small fee to get copies of these records, so keep a receipt for this.

Further on the topic of costs and receipts. Make sure that you keep the receipts of any transactions which are related to your accident. This allows us to accurately calculate what we should claim for, for you.

What can you claim for after an accident at Haven Holidays?

There are several things which can go towards making up a personal injury claim settlement. As well as providing compensation directly for your injuries, these can also compensate you for the wider impact that an injury, especially and injury on holiday, can have upon you.

If you have been injured or have suffered food poisoning whilst on holiday, it is very likely that this will have had a major impact on your overall level of enjoyment of the holiday. As such, you could be able to claim compensation for this lost enjoyment.

Whilst it is likely that you will be treated by the NHS if involved in an accident and need to make a Haven Holiday camp compensation claim, you may still have needed to have bought prescription medication after this, or you may have had to pay to get to the doctors or hospital. If so, keep receipts of these as you could include such costs as a part of your claim.

Similarly, if you had to return home, purchasing an extra travel ticket or having to pay additional costs, you could also be able to include these in your caravan site accident claim. You may have also encountered numerous other different types of expense related to your injury or the illness you suffered. It can sometimes be difficult to remember all of these costs, so do keep receipts for everything.

The effects of your food poisoning or accident might not end when you get home. If you have suffered a broken limb you may need to take time off work and lose income or fail to accrue workplace benefits. If this has been the case, keep track of this lost income as you may also be able to claim for earning that you have already lost, and that which you may lose in the future.

There are other things which you may be able to include in your Haven Holiday camp compensation claim. These may include future medical care of physiotherapy, or help around the home if needed during your recovery. If a loved one has also had to take time of to care for you, you may also be able to recover their lost income as well. Even things such as additional child care costs incurred whilst you were not able to look after them fully can be included.
