Time limits for starting your claim

It’s important to establish whether your accident took place in the last three years due to legislation which puts a time limit on personal injury claims. The Limitation Act 1980 makes it a requirement (in most circumstances) that any personal injury claim for an accident should begin within three years of whenever the accident took place. If the nature of the accident meant that the injuries or illnesses couldn’t be instantly confirmed, then the starting point for the time limit is when they were diagnosed (the ‘date of knowledge’).

There can be exceptions to how the time limit for claiming works for certain people. For instance, if the injured victim is a child, the three year time limit will not immediately apply to them. Instead, the day of the victim’s 18th birthday is when the time limit starts. It’s also the same day when the victim will become old enough to begin a claim on their own. Before the victim reaches the age of 18, a claim could potentially be started on the child’s behalf. This could be arranged by someone willing to represent the victim as a litigation friend. This representative is usually someone close to the child who can be trusted to protect their interests, such as a parent.

Another way the three year time limit may be put on hold is when the victim does not have sufficient mental capacity to make decisions on their own. Similarly with children, a litigation friend may be able to start a claim on the behalf of a victim who is currently lacking in mental capacity (provided they are someone close to the victim who can be trusted to protect their interests).
