I’m In South Shields, Have I Got a Claim?
If you can answer yes to any of these questions then you may be able to make a personal injury claim with our South Shields personal injury team:
- Have you been involved in an accident that took place in the last three years?
- Was the accident not or not completely your fault?
- Have you sustained some form of injury?
What To Do Next
If you have been involved in an accident it is important that you gather as much evidence as you possibly can. This can include:
- Names and addresses of witnesses
- Police reports (if applicable)
- Accident book records
- Medical reports
Getting as much information like this will help us give you the best advice about the merits of your claim.
Time limits for starting your claim
It’s important to establish whether your accident took place in the last three years due to legislation which puts a time limit on personal injury claims. The Limitation Act 1980 makes it a requirement (in most circumstances) that any personal injury claim for an accident should begin within three years of whenever the accident took place. If the nature of the accident meant that the injuries or illnesses couldn’t be instantly confirmed, then the starting point for the time limit is when they were diagnosed (the ‘date of knowledge’).
There can be exceptions to how the time limit for claiming works for certain people. For instance, if the injured victim is a child, the three year time limit will not immediately apply to them. Instead, the day of the victim’s 18th birthday is when the time limit starts. It’s also the same day when the victim will become old enough to begin a claim on their own. Before the victim reaches the age of 18, a claim could potentially be started on the child’s behalf. This could be arranged by someone willing to represent the victim as a litigation friend. This representative is usually someone close to the child who can be trusted to protect their interests, such as a parent.
Another way the three year time limit may be put on hold is when the victim does not have sufficient mental capacity to make decisions on their own. Similarly with children, a litigation friend may be able to start a claim on the behalf of a victim who is currently lacking in mental capacity (provided they are someone close to the victim who can be trusted to protect their interests).
How Much Is My South Shield Claim Worth?
Because personal injury claims are all unique, it’s not possible at the outset to say EXACTLY how much your claim is worth, although from a brief chat over the phone we will be able to give a general estimation. To understand this more, it’s worth taking a look at what compensation is made up of.
Firstly, you are entitled to be compensated for any pain, suffering or upset that may have been caused by your accident. This may be worth a few hundred pounds for relatively minor injuries to many thousands of pounds for more serious and significant injuries. This is referred to as general damages and our South Shields team of injury solicitors will give you all the advice you need regarding this matter.
The other element of any compensation claim is called special damages. This essentially refers to any expenses that you may have had to pay out thanks to your accident. You may have damaged your clothing during the accident, you may have had to take time off work and lost wages and you may have incurred travelling expenses going to doctors appointments. You will need receipts and evidence of all these types of losses. More serious accidents may also have a third element, money for ongoing medical rehabilitation and nursing care.
How Long Will My Claim Take?
Like trying to give an accurate figure as to how much your claim is worth early on, it is also difficult to give you an exact timescale as to how long your claim will take. For example, a relatively straightforward case of whiplash may take about three months to settle whereas a more serious injury may take longer as it is not possible to settle it completely until the medical prognosis is certain.
What we can say is that we will always ensure that we act in a timely manner to ensure your case is settled as soon as it can be without compromising the amount of compensation that you may receive.
How Much Will My Claim Cost?
All of our solicitors, including those for our South Shields clients work on a No Win No Fee agreement, otherwise known as the conditional fee agreement. Essentially this means that our solicitors do not take a fee in the unlikely situation that your claim is unsuccessful. When we have successfully won you compensation, however, we will be paid from what’s known as a success fee. This success fee will all be agreed before you take out your claim so when you come to accept your compensation, you’ll know exactly how much you will receive.
Please feel free to ask about our fees. We have no extra costs or hidden charges.
