A Guide To KGM Motorcycle Insurance Claims
If you’ve suffered an injury in a motorbike accident caused by a rider who was insured by KGM motorcycle insurance, you may be able to make a KGM motorcycle insurance claim against the at-fault party’s insurance policy. Whether you have suffered a minor injury such as whiplash, or serious life-changing injuries, this guide explains all you may need to know about making a motorcycle injury claim.
In the sections below, you will find details of how to make a motorcycle injury insurance claim against a liable party. We include details of compensation amounts for specific injuries that could be sustained in a motorcycle accident, as well as information about claiming if you are partially at fault for an accident. While we cover information relating to KGM motorcycle insurance claims on this page, it may be of interest to know that we could help with a variety of other road traffic accident claims too.
What Are Claims Against KGM Motorcycle Insurance Policies?
KGM Insurance is an insurance intermediary, as well as being a Lloyd’s coverholder. This company provides motorcycle insurance deals through several different insurers. When you take out a policy through KGM insurance, the name of the insurer on your policy would be your actual insurer, but KGM underwriting service would be the company approached by the broker to underwrite the policy. If a person who has been insured by KGM insurance through a broker is at fault for a motorcycle-related injury caused by an accident, you could make a claim against the insurer mentioned on the at-fault party’s KGM motorcycle insurance policy.
What Motorcycle Accidents Could I Claim For?
Various types of accidents could lead to a KGM motorcycle insurance claim. If you are insured through KGM insurance you may be able to claim against your own policy for:
- Damage to your vehicle if an accident was your fault
- Your own injuries – If you have fully comprehensive insurance and the at-fault party is not insured, your injuries could be claimed for on your own policy.
- Someone else’s injury – if you had a passenger on your motorbike and they were injured in an accident you were at fault for, they could claim against your KGM insurance policy
You could claim against someone else’s KGM motorbike insurance policy if:
- They were at fault and damaged your vehicle
- They were at fault and you suffered injuries
- They were at fault and a passenger suffered injury – in these cases the passenger would claim against the at-fault party’s insurer.
In some cases, you could be in an accident caused by someone who was not insured or who fled the scene of the accident. If this is the case, this may not preclude you from making a claim. Claims of this nature could be made through the Motor Insurer’s Bureau (MIB). MIB claims are another type of claim we could help with.
Are KGM Motorcycle Insurance Policies Sold Through Brokers?
While KGM insurance provides underwriting services for a variety of insurers, they do not directly sell policies through their website to the public. Instead, their network of KGM insurance brokers sells their policies, which KGM provides to them on a wholesale basis.
Some of the brokers who could sell KGM motorcycle insurance policies could include:
- Be Wiser Insurance
- BeMoto
- HR Insurance
What Considerations Do Insurance Companies Make Before Paying Out?
When assessing a motorbike injury claim, an insurance company would take into account various factors. They could look at things like:
- Where the accident occurred – If the insurance policy only covered accidents on public roads and the accident occurred on a driveway, for example, the insurance company may dispute the claim.
- Whether you were within the personal injury claims time limit – Usually, the time limit for such accidents would be 3 years from the date of the accident. However, there could be some exceptions to this.
- The police report – if there was a police report, the insurer could examine this to see if you could have been at fault in any way for the accident.
- Your medical information – if you suffered a motorcycle hand injury, for example, the insurer might ask for evidence from an independent party on the severity of such an injury before paying out on your claim.
If your KGM motorcycle insurance claim has been disputed or rejected unfairly, getting a personal injury solicitor to fight for compensation on your behalf could result in you receiving the compensation you deserve for your injuries.
How Could I Secure A Better Settlement?
Using a personal injury solicitor for your motorbike accident claim could result in you receiving a better settlement for your injuries.
A solicitor would also have the capability to build a strong case against the liable party. They could help collect evidence relating to your claim and could present this in a manner that would be difficult for the liable party to argue against. Not only this, but they could also advise you on what could be an appropriate settlement to take if you receive an offer of compensation, or whether you could reject an offer and fight on for a higher settlement.
While you may be under the assumption that rejecting a settlement and fighting for more motorbike injury compensation might mean you would end up in court, this would not usually be the case. Usually, claims are settled outside of the courtroom, although if negotiations are not likely to be resolved during the limitation period for your claim, your solicitor may issue court proceedings so that your claim would not be time-barred. This could give them more time to negotiate with the insurer of the at-fault party, or to gather more information relating to your claim.
Do I Have To Accept An Insurance Companies Settlement?
As we mentioned, you are under no obligation to accept an insurance settlement from an insurance company for your claim. While some insurers may issue you with a very swift offer of compensation, this may be a pre-medical offer, which would not take into account the medical evidence you could gather as part of your claim. Pre-med offers are sometimes used by insurance companies to avoid legal costs and disbursements, such as the cost of you attending an appointment with a medical expert as part of your claim.
However, we would not recommend you accept a pre-med offer, as this would usually mean if further injuries presented themselves, you would not be able to claim for them. Even if you have seen your GP about your injuries, it would be wise to seek a medical report from an independent specialist as there may be further injuries that may not have been taken into account by your GP, and the prognosis you’ve received may not be accurate.
Rejecting an insurance company’s settlement for a KGM motorcycle insurance claim does not mean you would not receive any other offer. A capable lawyer could argue your case for compensation to ensure you receive the maximum compensation possible for your claim.
What Information Should I Provide My Solicitor?
Information you could provide to your solicitor to help prove your KGM motorcycle insurance claim could include:
- Details of the police report
- Pictures of the accident scene
- A sketch of the position of the vehicles involved
- Your medical notes, although your solicitor could request these later
- Details of your injuries, with any photographic evidence
- Your own account of the accident and your injuries, including how they have affected you
- Details of any witnesses to the accident
- Proof of any expenses you’ve incurred as a result of your injuries
Could I Claim Compensation For My Injuries Or Accident?
Claiming compensation against someone who was insured through KGM motorcycle insurance could be possible in a variety of scenarios. You could claim compensation if you are a blameless victim of a motorbike accident who was a:
- Pedestrian
- Passenger on a motorbike
- Rider of a motorbike
- Driver of another vehicle
- Passenger of another vehicle
- Another road user
What Happens If I Am Partially At Fault?
While if you are totally at fault for the accident, you would not be able to make a claim for your own personal injuries, if you are partly to blame for a motorbike accident that causes you to suffer injury, you may still be in a position to make a KGM motorcycle insurance claim.
These could be what is known as split liability claims. If both road users admit partial responsibility for the accident, on a 75/25 basis, for example, you could receive 75% of the value of your claim from the other person’s insurer.

Calculating Claims For Motorbike Accident Compensation
A common question that some claimants may have surrounds the amount of compensation that could be awarded for their claim. If you have sought out a personal injury claims calculator to provide this information to you, we should advise you that the amount you receive from such a calculator would only be a rough estimate. All claims are assessed on their unique circumstances and facts, and no two cases are the same.
You would be required to undergo a medical assessment with an independent doctor as part of your KGM motorcycle insurance claim to verify the injuries you’ve sustained and give details of your prognosis. The report completed by the independent medical expert could then be used to give a more accurate value to your motorcycle injury claim.
To give you some idea of how much compensation could be appropriate for your injuries, we have included a table below with compensation brackets from the Judicial College Guidelines. This is a legal publication that could help solicitors and the courts arrive at an appropriate value for personal injury claims. If you do not see the injury you’ve sustained in the table below, please do get in touch – we could offer further insight over the phone.
Nature of injury | Judicial College Guideline Bracket | Remarks |
---|---|---|
Ankle injuries – Very severe | £46,980 to £65,420 | Extraordinary injuries that are very severe could result in payouts within this bracket. One example would be an injury so severe that future damage to the leg would result in a below-knee amputation. Another example could be a transmalleolar fracture with extensive soft tissue damage leading to deformity. |
Ankle injuries – Severe | £29,380 to £46,980 | Injured parties would need to undergo lengthy treatment which could lead to a long time being spent in plaster. Plates and pins may be required but there could still be a significant disability despite this treatment. |
Ankle injuries – Modest | Up to £12,900 | Less serious bones and tears to ligaments that could lead to some continuing issues with walking on uneven paths, climbing stairs, etc. |
Hip and pelvis injury – Severe | £73,580 to £122,860 | Extensive fracture/s of the pelvis that could involve severe complication including ruptured bladder, hip injury, or lower back dislocation. Residual disability could be significant, and could include sexual function problems, or issues with bowel or bladder control. |
Hip and pelvis injury – Severe | £58,100 to £73,580 | Marginally less severe than injures in the bracket above. However, they would have extenuating features that would distinguish them from lower brackets. For example, fracture dislocations of the pubic + ischial rami causing impotence. |
Hip and pelvis injury – Lesser | Up to £3,710 | Minor soft tissue injuries with an expected fully recovery. |
Neck injuries – Severe | £61,710 to £122,860 | Involving serious disc damage or fracture causing disabilities of a considerable severity. Brachial plexus injury (permanent) could be an example of this. |
Neck injuries – Moderate | £12,900 to £23,460 | Wrench-type injuries that are severe or serious soft tissue injuries causing serious limitation of movement could be included here, as could injuries causing cervical spondylosis, with recurring pain and a need for future surgery. |
Neck injuries – Minor | Up to £2,300 | Damage to soft tissue that resolves fully within 3 months. |
Brain injury – Less Severe | £14,380 to £40,410 | A normal work and social life would be possible for the affected person, but some minor issues with concentration or memory could persist. |
Motorbike Accident Claims Special Damages
Along with the motorcycle injury compensation you could receive for the pain, the suffering and the loss of amenity caused by your injuries, you could also be compensated for financial expenses caused by your injuries. These could include:
- Wage losses – If your income has been adversely affected by your motorcycle accident because you have lost pay from having to take time off work to recover from your injuries, loss of income could form part of your KGM motorcycle insurance claim. If your injuries were so severe that you weren’t able to return to work, you might be able to also claim future loss of earnings too.
- Care costs – If you required assistance with activities like toileting, dressing or food preparation because of your injuries, the costs associated with such care could be claimed for as special damages.
- Travel costs – You may have needed to travel to doctors or hospital appointments due to your injuries or to meet with your lawyer. Costs such as these could also be included within your claim.
- Medical expenses – Have you had to pay for medical costs such as prescription fees, physiotherapy or counselling, for example? If so, these costs could be claimed for as special damages.
It is vital that you keep copies of any documentation relating to your motorcycle accident claims, such as payslips, bank statements and receipts. If you are unable to provide evidence that you have been affected financially by your injuries, you would not be able to claim for such expenses.
No Win No Fee Motorbike Accident Claims
If you are considering finding a lawyer to help you with your KGM motorcycle insurance claim then you may be under the misapprehension that you would have to pay for these services upfront. However, this would not be the case if you chose to make a claim on a No Win No fee basis. With this type of claim, you would not have to pay your personal injury solicitor until they had secured you a compensation payout.
At the start of a No Win No Fee claim, you would have to complete and sign a CFA, which is known as a Conditional Fee Agreement. This document would effectively give your lawyer a promise to pay them a small ‘success fee’ if they were able to secure you a compensation payout. The success fee would be legally capped and would be discussed with you fully before you signed the agreement to pay it. If your lawyer wasn’t able to secure you any compensation, you would not be expected to pay for their costs incurred while pursuing your claim, and you would not have to pay the success fee either.
We are aware that you may have questions about claiming in this manner. If you do, or you would like our help in finding an appropriate lawyer for your claim, please do get in touch with us. We’d be glad to help.
