How Much Compensation For Dermal Filler Injuries And Dermal Lip Filler Negligence Botched

By Jo Greenwood. Last Updated March 2024. Welcome to our guide to making a claim for a dermal filler injury.

Dermal fillers have become exceptionally popular in the UK over the past decade or so. This is a procedure that is used to add fullness to areas such as the lips, bridge of the nose, and cheeks, as well as fill out facial lines to reduce the appearance of wrinkles. Dermal fillers are supposed to leave you feeling confident and happy with your appearance, but when something goes wrong, the opposite can occur. While the procedure is safe, complications can arise if it is not carried out properly. If you have been the victim of dermal lip filler negligence, you will be able to launch a claim. A guide to accident claims for dermal filler injuries

Dermal Filler Injuries Negligence

Dermal Filler Injuries Negligence

We have dealt with many different types of personal injury claims over the years, from road traffic accidents to incidents in the workplace. However, something we are seeing more and more of is claims for dermal fillers gone wrong. This is not because of a lack of regulation or safe procedures, but more to do with the popularity of the treatment. While it is safe to carry out on the whole, there are occasions whereby the dermal filler is not injected properly, and this can lead to unwanted consequences. If you have experienced this, there is a very high chance that you will be entitled to compensation.

We can help you to launch a successful claim and get the maximum payout you deserve. But, first, why not read on to find out more about dermal filler personal injury claims. In this guide, we cover everything you need to know. This includes information on what dermal filler is, what to do if the procedure goes wrong, whether you can claim compensation for a variety of scenarios, how much money you could receive, and how to go about making a claim.

What is a dermal lip filler?

Dermal filler lips procedures are very popular. More and more people are seeking this treatment in the pursuit of plumper lips. The treatment usually takes about 45 minutes, and involves a type of material being pumped into the lips. This can be on a permanent or temporary basis, depending on the type of filler. Common options include:

  • Polymethylmethacrylate beads (PMMA) – This is a permanent type of injection, yet it is the riskiest.
  • Poly-L-lactic acid (PLLA) – These injections tend to last between several months and two years.
  • Calcium hydroxylapatite – These fillers last approximately 18 months.
  • Hyaluronic acid – These fillers last between four and six months.
  • Collagen – These dermal fillers will last between three and four months.

Dermal fillers aren’t only used to increase the volume and definition of the lips. Cheek filler and dermal filler nose procedures are also popular, and they can help to fill out creases and wrinkles in the skin.

Statistics about dermal fillers in the UK

The number of people undergoing a lip filler procedure is growing. According to the International Society of Aesthetic Plastic Surgery’s Global Survey, one of the top 5 non-surgical procedures worldwide includes those involving hyaluronic acid. The survey showed that there were around 4.3 million procedures involving hyaluronic acid which is an ingredient used in lip fillers.

The survey also showed that there was a 15.7 per cent increase in 2018.

Although the statistics do not highlight cases of dermal fillers gone wrong, they do give an insight into how popular the procedure is.

Cosmetic Claims – Can I Claim For A Lip Filler Infection?

Following a lip filler infection, you might seek to claim medical negligence compensation. However, in order to be eligible to claim, the practitioner must have acted negligently and caused you harm. If there is no evidence to suggest that negligence caused you harm, your claim will not be successful.

You should meet the following requirements if you wish to claim for medical negligence:

  • You were owed a duty of care by your surgeon
  • They breached this duty of care
  • You were subsequently caused avoidable harm

Below are some examples of when cosmetic claims could be valid:

  • You suffered from an infection due to poor hygiene standards of the equipment used for your procedure.
  • The person who inserted your filler used harmful or unsafe substances.
  • The procedure was performed incorrectly, causing you to suffer tissue damage or a blood vessel becoming blocked

We’ll discuss how to prove medical negligence later on in this guide. If you have any questions about claiming, speak with a member of our team.

Lip Filler Gone Wrong – Examples Of Evidence

The strength of your claim could depend on the supporting evidence you can provide. If possible, you should try to collect and retain any evidence that could show:

  • How negligence had occurred in your procedure
  • The harm you sustained from the procedure
  • The impact of the harm to your life

Examples of evidence you could provide includes:

  • Copies of the correspondence you have had with the clinic about your treatment
  • Proof of any medical advice that you may have received prior to your treatment
  • Pictures that you may have taken of how your lip injection had gone wrong
  • A medical report of your injuries following the procedure
  • Payslips that could show how your income had been affected
  • Proof of your injury related spending such as receipts or bank statements

Our advisers can provide you with a free consultation to advise you over what evidence you could gather. They are available by live chat or by using the contact information at the top and bottom of the page.

What can be claimed for if my dermal filler goes wrong?

You will be able to claim the following:

  • General damages – This will cover the pain and suffering you have experienced.
  • Special damages – this may cover the following:
    • Travel expenses
    • Loss of income
    • Medical expenses
    • Care claim – If you have required help around the house during your recovery, the person that has cared for you can make a claim.

What is dermal filler used for?

Dermal fillers are used to give a person’s lips and cheeks greater definition and more volume. Dermal filler injections can also be used to reduce the appearance of lines and wrinkles, which is why dermal filler under the eyes is a popular procedure.

Can I claim compensation if I had an allergic reaction to the dermal filler?

If you have had an allergic reaction to the dermal filler injections you were given, and you did not receive proper advice beforehand, you will have grounds to make a claim. If your surgeon did not ask about your allergies or failed to advise you on the potential side effects, then they have put you at risk, and they are, therefore, liable for the injuries you have suffered.

Can I claim compensation if I signed a disclaimer before getting my dermal filler?

You will be able to make a claim even if you have signed a disclaimer. Signing a disclaimer does not mean the surgeon is covered irrespective of the circumstances. They still need to act responsibly and follow the correct procedure. If they have acted negligently, you still have the basis for a successful claim.

How long do I have to claim compensation for a dermal filler injury?

You have three years to make a claim from the date of the incident, which will be your dermal filler treatment date. In the vast majority of cases, the symptoms will be instant. However, in rare cases, symptoms arise after a number of years. If this is the case, you will have three years from the date of your diagnosis. It is advisable to claim sooner rather than later; the details will be fresh in your mind and gathering evidence will be a lot easier. You should never leave it to the wire; court proceedings need to be issued within the three-year time frame.

Can I claim compensation if my dermal filler wasn’t administered by a nurse?

If someone with the correct qualifications did not administer your dermal fillers, you will be able to make a claim, so long as you were not aware of the fact. If you allowed someone unqualified to carry out the procedure, you may be deemed at fault as well. Please do not hesitate to call us for further clarification.

Lip Filler Gone Wrong – Calculating Compensation

The portion of your settlement that is calculated in line with your level of pain and suffering is called a general damages payment. A lip filler gone wrong can result in a variety of different injuries. The severity of these issues can also vary.

Because of this, legal professionals will often turn to the Judicial College Guidelines (JCG) to calculate an appropriate figure. This publication contains example amounts that have been based on past court cases. It was last updated in 2022.

The table below shows some excerpts from the JCG for injuries that could occur due to bad lip fillers. You can use the table to get a rough idea as to the value of your claim for a botched lip filler. However, all claims are unique. Therefore, your own circumstances will likely affect how much you could receive in compensation.
