How Much Compensation For Dermal Filler Injuries And Dermal Lip Filler Negligence Botched

By Jo Greenwood. Last Updated 3rd July 2024. Welcome to our guide to making a claim for a dermal filler injury.

Dermal fillers have become exceptionally popular in the UK over the past decade or so. This is a procedure that is used to add fullness to areas such as the lips, bridge of the nose, and cheeks, as well as fill out facial lines to reduce the appearance of wrinkles. Dermal fillers are supposed to leave you feeling confident and happy with your appearance, but when something goes wrong, the opposite can occur. While the procedure is safe, complications can arise if it is not carried out properly. If you have been the victim of dermal lip filler negligence, you will be able to launch a claim. Read on for more information.

Lip Filler Gone Wrong – Calculating Compensation

The portion of your settlement that is calculated in line with your level of pain and suffering is called a general damages payment. A lip filler gone wrong can result in a variety of different injuries. The severity of these issues can also vary.

Because of this, legal professionals will often turn to the Judicial College Guidelines (JCG) to calculate an appropriate figure. This publication contains example amounts that have been based on past court cases.

The table below shows some excerpts from the JCG for injuries that could occur due to bad lip fillers. You can use the table to get a rough idea as to the value of your claim for a botched lip filler. Additionally, we’ve added a figure in the top row to show you how compensation could be awarded in a botched dermal filler claim for multiple injuries and special damages. This figure is not from the JCG. However, all claims are unique. Therefore, your own circumstances will likely affect how much you could receive in compensation.

InjurySeverityGuideline Amount

More payouts for botched lip filler claims

The table above relates to the general damages head of claim which compensates for the pain and suffering caused by your injuries.

In addition, you could receive a second head of claim called special damages. These seek to compensate for the financial losses incurred as a result of the injuries you sustained.
They could include:

  • Care costs
  • Medical expenses
  • Travel expenses
  • Loss of earnings

However, sufficient evidence would need to be provided in order to claim these back. For example, you could provide payslips to prove any lost earnings.

Cosmetic Claims – Can I Claim For A Lip Filler Infection?

Following a lip filler infection, you might seek to claim medical negligence compensation. However, in order to be eligible to claim, the practitioner must have acted negligently and caused you harm. If there is no evidence to suggest that negligence caused you harm, your claim will not be successful.

You should meet the following requirements if you wish to claim for medical negligence:

  • You were owed a duty of care by your surgeon
  • They breached this duty of care
  • You were subsequently caused avoidable harm

Below are some examples of when cosmetic claims could be valid:

  • You suffered from an infection due to poor hygiene standards of the equipment used for your procedure.
  • The person who inserted your filler used harmful or unsafe substances.
  • The procedure was performed incorrectly, causing you to suffer tissue damage or a blood vessel becoming blocked

We’ll discuss how to prove medical negligence later on in this guide. If you have any questions about claiming, speak with a member of our team.

Can I claim compensation if I signed a disclaimer before getting my dermal filler?

You will be able to make a claim even if you have signed a disclaimer. Signing a disclaimer does not mean the surgeon is covered irrespective of the circumstances. They still need to act responsibly and follow the correct procedure. If they have acted negligently, you still have the basis for a successful claim.

Can I claim compensation if my dermal filler wasn’t administered by a nurse?

If someone with the correct qualifications did not administer your dermal fillers, you will be able to make a claim, so long as you were not aware of the fact. If you allowed someone unqualified to carry out the procedure, you may be deemed at fault as well. Please do not hesitate to call us for further clarification.

How long do I have to claim compensation for a dermal filler injury?

You have three years to make a claim from the date of the incident, which will be your dermal filler treatment date. In the vast majority of cases, the symptoms will be instant. However, in rare cases, symptoms arise after a number of years. If this is the case, you will have three years from the date of your diagnosis. It is advisable to claim sooner rather than later; the details will be fresh in your mind and gathering evidence will be a lot easier. You should never leave it to the wire; court proceedings need to be issued within the three-year time frame.

Lip Filler Gone Wrong – Examples Of Evidence

The strength of your claim could depend on the supporting evidence you can provide. If possible, you should try to collect and retain any evidence that could show:

  • How negligence had occurred in your procedure
  • The harm you sustained from the procedure
  • The impact of the harm to your life

Examples of evidence you could provide includes:

  • Copies of the correspondence you have had with the clinic about your treatment
  • Proof of any medical advice that you may have received prior to your treatment
  • Pictures that you may have taken of how your lip injection had gone wrong
  • A medical report of your injuries following the procedure
  • Payslips that could show how your income had been affected
  • Proof of your injury related spending such as receipts or bank statements

Our advisers can provide you with a free consultation to advise you over what evidence you could gather. They are available by live chat or by using the contact information at the top and bottom of the page.

Examples of dermal fillers gone wrong

In this section we look at some examples of lip filler gone wrong and how such errors can happen. While, in some cases, they may not be medical professionals, dermal fill practitioners are nonetheless required to undergo training and qualification, and abide by proper hygiene and standards of professionalism.

Potential scenarios of failures to uphold these standards can lead to injury include:

  • Your practitioner used a filler you had a known allergy to, causing severe anaphylaxis.
  • Improper hygiene practices at the clinic resulted in you contracting an infection due to an unsterilised needle.
  • The filler was incorrectly injected and caused a blood vessel blockage around your mouth.

There are, of course, various other ways in which a dermal filler injury could occur. To get an assessment of your eligibility to claim in your particular circumstances, contact our advisors today using the contact information provided below.

Claim For A Dermal Filler Injury With A No Win No Fee Lawyer

If you are eligible to start a claim for botched fillers, you may wish to have a lawyer work on your case. A lawyer could help with gathering evidence, and they could negotiate a compensation settlement for you.

If you’re concerned about the cost associated with using a lawyer for a claim for lip filler gone wrong, you may wish to consider claiming under a No Win No Fee arrangement.

One of our lawyers may offer their services under a type of No Win No Fee contract known as a Conditional Fee Agreement (CFA). This means that you would not have to pay your lawyer at the beginning of your claim or as it progresses. Furthermore, if you are not awarded compensation, your solicitor will not expect a payment for their work on your claim.

If your claim succeeds, your lawyer will take a success fee from your compensation. This is subject to a legal cap and is a small percentage of your payout.

To learn more about No Win No Fee claims and check your eligibility to work with one of our lawyers, you can contact our advisors. They would be happy to answer your questions, and let you know whether one of our lawyers could assist with your claim.
