What Happened To Mr Miller?

In our example case study*, Mr Miller was doing his usual morning shop in his local supermarket when he suddenly slipped and fell heavily on a wet floor. This led to Mr Miller landing head-first and being knocked unconscious. 

At the time, staff were mopping aisles, but neglected to put out wet floor signs to alert customers to the slippery surfaces. Staff subsequently called the emergency services, and Mr Miller was rushed to hospital.

What Injuries Were Sustained?

Mr Miller sustained multiple serious injuries in the form of skull and vertebral fractures, as well as long-term anxiety. The head trauma caused brain damage that affected his concentration and memory, and left him with permanent dizzy spells and vertigo.

He was unable to return to work as a scaffolder, resulting in a considerable loss of income. His injuries also led to isolation, and he was rarely able to leave the house following the accident. Facing significant financial losses, Mr Miller decided to pursue compensation with a specialist public liability solicitor.

The solicitor proved that the supermarket’s failure to display wet floor signs meant it fell short of its obligations to visitor safety as the occupier of a public space. That responsibility (referred to as a duty of care) is set by the Occupiers’ Liability Act 1957.

Under this legislation, third parties in control of public spaces are required to take practical steps to keep visitors, such as Mr Miller, reasonably safe. Thanks to the support of his solicitor, Mr Miller was awarded £500,000 in head injury compensation.

The Head Injury Compensation Settlement

Mr Miller’s head injury compensation settlement consisted of £210,000 for his physical and psychological injuries and £290,000 for his financial losses. His payout comprised 2 categories of damages:

  • General damages: Covered the pain and suffering of his head injury, fractured vertebra, and anxiety, together with the adverse impact on his quality of life.
  • Special damages: Encompassed Mr Miller’s lost earnings, as well as the cost of occupational therapy, physiotherapy, and counselling.

He needed payslips, bank statements, and invoices to prove his losses, as special damages can only be claimed for if there is evidence of out-of-pocket expenses resulting from an injury.
