What Happened?

In our example case study*, Mr Lund was on a ladder fixing electrical wiring on a construction site. However, supervisors of the site did not complete a safety inspection, failing to recognise that the ladder was faulty. 

Consequently, the claimant fell off the unstable ladder and sustained serious injuries. A first aider, who was also on the construction site, contacted emergency services, and Mr Lund was taken to the hospital to receive treatment for his injuries.

How The Chest Injury Impacted The Individual

The workplace accident impacted the claimant in numerous ways. For example, it caused him to sustain chest injuries of a serious nature, consisting of two broken ribs and a punctured right lung. The circumstances of the accident and the injuries also led to the claimant suffering from psychological injuries, namely depression. 

Further, as a result of the claimant’s injuries and hospital admission, he was required to take 5 weeks off work until he made a full recovery. This resulted in him incurring lost wages and momentary losses due to medical costs.

The Chest Injury Compensation Payout

Under the Health and Safety at Work etc. Act 1974, they found that Mr Lund’s employers owed him a duty of care to take reasonable steps to ensure Mr Lund was safe at work. However, they failed to do so and were in breach of their duty, resulting in Mr Lund’s chest injuries. As a result, his claim was successful and he was awarded a compensation payout.
