Who Can Claim Stabbing Compensation?
Direct victims, secondary victims, and certain family members can claim stabbing compensation through the Criminal Injuries Compensation Authority if they satisfy the CICA’s eligibility criteria for applications.
If you were a direct victim of a stabbing, you would need to meet the requirements outlined above. Specifically, that the stabbing happened in Great Britain, was reported to the police, resulted in you sustaining a qualifying criminal injury, and that the claim is being filed within 2 years of it occurring.
Even if you did not sustain physical injuries, you may still be able to pursue compensation as a secondary victim if you suffered a diagnosed, disabling mental injury because of a stabbing. You will need to show that you have a close relationship to the victim, and that you witnessed your loved one’s stabbing or were otherwise physically present in the immediate aftermath (rather than through television or social media).
If a loved one sadly dies as a result of a stabbing, qualifying relatives may be eligible to receive compensation, including bereavement payments. These relatives include:
- The spouse or civil partner of the deceased
- A child or a parent
- A partner who lived in the same household for at least 2 years before the death
- A spouse or civil partner who was financially dependent on them
- A partner or spouse of the deceased who could not live with them due to health issues

What Is The Criminal Injury Compensation Authority (CICA)?
The Criminal Injuries Compensation Authority (CICA) is a government-funded agency that provides those who have suffered from violent crimes with a route to claim compensation for their injuries. There are other methods of seeking compensation, such as claiming directly against the perpetrator or a vicariously liable party such as your employer. These avenues should be considered before making a CICA claim.
Compensation in criminal injury claims is awarded according to the tariff in the Criminal Injuries Compensation Scheme 2012. Later in the guide, we examine compensation for being stabbed in greater detail.

How Much Compensation For A Stabbing Injury?
Providing a figure for the average compensation for being stabbed that the CICA paid out would not be beneficial to you. Every claim falls into a fixed tariff, depending on the injuries. We will examine some traffic below.
As we touched on above, compensation in criminal injury claims is awarded per the tariff in the Criminal Injuries Compensation Scheme 2012. We have included some examples from the scheme below. As the tariffs are fixed, this means the amount listed is what will be paid out.
Compensation Table
Please take note that the top entry is the highest amount the CICA will pay for any type of claim.
| Injury | Severity | Compensation Figure |
|---|---|---|
| Multiple Very Serious Injuries + Loss of Earnings and Special Expenses | Very Serious | Up to £500,000 |
| Paraplegia - Paralysis of lower body | Substantially Complete | £175,000 |
| Moderate but Substantially Incomplete | £110,000 | |
| Arm | Loss of One Dominant Arm | £55,000 |
| Loss of One Non-dominant Arm | £33,000 | |
| Other Payments | Infection with HIV, Hepatitis B or C | £22,000 |
| Finger and Thumb | Loss of Thumb | £16,500 |
| Loss of Index Finger | £6,200 | |
| Abdomen | Repair of 3+ organs | £6,200 |
| Repair of 2 organs | £3,500 |
£500,000 is the maximum that the CICA will pay out. In the event that you have experienced multiple injuries, the formula stipulates that:
- The full amount will be paid for the injury with the highest value.
- 30% will be paid for the next highest, or an injury of the same value.
- And 15% will be paid for the third greatest, or an equal value injury.
Compensation will only be paid for a maximum of 3 injuries in a criminal injury claim. However, if you were infected with an STI, if the blade was contaminated, or if you lost a foetus due to being stabbed, then payments from a different tariff outside of the aforementioned formula can be made.

Do You Have To Report The Stabbing To Police?
Yes, in order to make a claim through the CICA, you must report the stabbing to the police. You must also:
- Cooperate with the police investigation
- Report the crime as soon as you can
- Obtain a Crime Reference Number (CRN)
How To Claim Compensation For Being Stabbed
Once your potential claim is deemed valid by our expert advisors, you’ll be connected with one of our highly experienced solicitors. Below, we have set out a few important aspects of the criminal injury claims process.
Gathering Evidence
There are three items of evidence required when making a claim through the CICA. These are:
- The crime reference number (it is of paramount importance that you report the crime to the police).
- Proof that the residency requirements apply to you.
- Medical proof showing what injuries were sustained and how serious they were.
You don’t need to provide proof of the crime, such as witness accounts or CCTV footage. The CICA will coordinate with the police to obtain this evidence.
Time Limits For Stabbing Compensation Claims
In most cases, there is a 2-year time limit to claim through the CICA. However, if exceptional circumstances prevented reporting the crime to the police straight away or making a claim within that time, then the CICA can still accept claims at their discretion.
It is, therefore, always worth getting in touch with our advisors to check if you could make a claim. They can provide additional guidance on the time limits and advise as to the best course of action.
No Win No Fee Criminal Injury Claims
You may have come across the phrase ‘No Win No Fee’ while researching criminal injury claims. This refers to an excellent fee arrangement that many solicitors offer. One of our solicitors could represent your case through a Conditional Fee Agreement (CFA), which works on this basis. It offers the benefit of not having to pay for your solicitor’s work:
- Before your claim starts
- While the claim is ongoing
- In the event that you do not receive compensation for being stabbed
However, if you are awarded compensation, you will be required to pay a success fee. This means that you will owe a percentage of the compensation to your solicitor. There is a legal cap in place, so you can rest assured that you will keep the largest share of the total.
Should you have any queries about how No Win No Fee agreements work, you can speak with an advisor at any time. We understand that trusting a solicitor to represent your claim is a big decision, so we offer our advice free of charge. There is also no obligation to follow up with Legal Expert after you have enquired.
How Long Do Stabbing Injury Cases Take?
The CICA make efforts to settle cases within 12 months. They appreciate that criminal injury claims are sensitive matters, and claimants will be seeking a timely settlement.
However, a timescale cannot be guaranteed. This is because each claim is unique and must be assessed on its own merits. The factors that may influence the time scale of stab compensation claims include:
- The amount of evidence you have supplied to support the case
- Whether CICA need to contact third parties (such as medical authorities or the police) for further information
- The severity of your injuries and whether you have fully recovered (they may need to assess the future impact of your suffering)
- Whether you disagree with CICA’s decision and choose to appeal
It may cause you some concern if your case is more complicated in nature and may take longer to settle. However, it may help you to know that one of our solicitors can help you to apply for an interim payment. This refers to a payment that some claimants are eligible to receive before a claim has been completely settled.
If you have any questions about claiming compensation for being stabbed, do not hesitate to speak with one of our advisors. They can explain the process of claiming compensation in further detail, which may help you to understand the factors that influence how long a claim could take.
