In our example case study,* We look at how Mrs Turner was able to sue a driver for not upholding road safety law. Mrs Turner, an avid motorcyclist, was riding with a group along a main road in her home town. A driver joining from a slip road was using their phone and merged onto the carriageway without looking. The driver clipped the back of Mrs Turner’s motorcycle and she lost control, crashing into the verge. She experienced a serious fracture to her humerus as well as damage to the tendons in her arm.

The arm injury compensation amount can be broken down into two heads of claim: general and special damages. General damages are paid out for physical and psychological harm, whereas special damages cover financial losses.
