£900,000 Compensation For A Below The Elbow Arm Amputation

£900,000 Compensation For A Below The Elbow Arm Amputation

In February 2011, a 29-year-old production line supervisor was injured while on the job. The person was involved in a waste and recycling workplace accident in Ayrshire, which cause him to have to undergo arm amputation surgery and, of course, this was followed by arm amputation rehabilitation. The injury happened when the person’s arm got caught in a 1.5-metre wide and 20-metre long rubber conveyor built. This was while he was trying to extract a tin from the machine and his glove got stuck. The conveyor belt pulled his arm into it, which quickly severed the limb traumatically from just underneath his shoulder, making it one of the more severe types of amputation.

Arm amputation

Arm amputation

As a result of the arm amputation, the individual was left without his left arm from the point of the proximal humerus. As you can imagine, this had a huge impact on his life, as he was no longer able to do daily tasks, nor could he continue with his job. Because of this, he was awarded £900,000 in compensation. Here at Legal Expert, we can help individuals that have been involved in similar incidents to get the payout that they deserve. If you are looking for amputation claim solicitors, look no further, as our team of specialists can ensure you have the best professional working on your case.

Consequences of The Arm Amputation

There are many different causes of amputation, yet all scenarios seem to have grave consequences. You only need to look at arm amputation statistics to see that this is the case. Unfortunately, this claimant was no different, and the arm amputation he suffered had a grave impact on his life. This includes familial, professional, and personal consequences.

The individual could no longer play games with his children, carry out a lot of basic household tasks, or work. He required two hours of assistance per day from other family members to assist with cleaning, cooking, and other domestic duties. If the arm amputation itself was not bad enough, he was also diagnosed with Chronic Adjustment Disorder and Post Traumatic Stress Disorder.

The road to arm amputation recovery was by no means plain sailing. As well as seeing a psychologist for the mental trauma that occurred, the production line supervisor needed to have extensive surgery, which included numerous skin grafts. The initial arm amputation surgery left the claimant with an ulceration tip at the amputation’s stump, meaning the bone needed to be trimmed back as well. Neuroma later developed, causing further complications, and it was ultimately deemed that his arm amputation would leave him in need of a prosthesis.

The Allegation and Compensation Award

In the end, the individual’s employer admitted the arm amputation was as a result of a workplace accident. However, he disputed the necessity of a practical prosthesis, stating an NHS-provided cosmetic prosthesis would have been substantial. This was a major sticking point, as the cost of a practical prosthesis was estimated to be roughly £600,000, and that is without accounting for maintenance. However, the solicitors provide the claimant’s need for the prosthesis, and in the end, £900,000 was awarded. This was a favourable outcome for the claimant, with £1.3 million being the aim. Nonetheless, with the defendant’s solicitors valuing the claim for arm amputation at £334,000, the victim certainly came out on top.
